Here's the legal bit - the Terms and Conditions that govern the hire and use of Rhyl Kitchen Classroom and its facilities. By confirming your booking, you agree to abide by the terms below. You can also download a PDF of this document here

Terms and Conditions 

1. Interpretation
1.1 In these Terms and Conditions the following definitions apply: 

- "We", "us", "Kitchen" and "RKC" are references to Rhyl Kitchen Classroom C.I.C.

- "You”, “your”, “hirer” are references to the “Client” named when booking the Kitchen.

- “Conditions” mean these Terms and Conditions for use of the Kitchen.

1.2 The headings used in these Conditions are for convenience only and will not affect the interpretation of any provision listed here.

2. Responsibility for the Booking and Services Provided
2.1 If you are booking on behalf of another company or organisation, you confirm that you are authorised to accept these Terms and Conditions on its behalf.

2.2 Your hire period should include all the time required to set up and clear away and clean each day. Any additional time spent on site may be liable to extra hourly charges which may be deducted from your deposit.

2.3 In the unlikely event of any mechanical breakdown, loss of energy or water supply, flood, fire or other unexpected act which may cause the Kitchen to be closed temporarily or for its function to be interrupted, RKC will not be held responsible or liable. RKC will offer a partial refund at its discretion for any hire hours affected.

2.4 Bookings are only confirmed once the hire invoice has been paid and the hirer has agreed to our Terms and Conditions either in writing and / or by ticking the relevant box on our online enquiry form. 

3. Rights of Access & Parking
3.1 If you hire the Kitchen for concurrent days, please be aware that you may not have exclusive use of the Kitchen outside of your agreed hours, as other bookings may be scheduled. For example, there might be an evening hire taking place after a daytime hire. 

3.2 We reserve the right to enter the Kitchen during a hire period.

3.3 This agreement does not confer any rights of car or vehicle parking unless by prior arrangement with RKC.

4. Care, Cleaning. Recycling & Rubbish
4.1 You are required to follow the Cleaning Checklist at the end of each day of your hire period. You are welcome to use the detergents, floor cleaner and other cleaning products provided in the grey locker located by the door to clean the Kitchen each day. If cleaning is not completed as required, RKC may deduct reasonable cleaning charges from your deposit, based on staff time.

4.2 We provide food waste bins (for cooked or uncooked food only) and bins for mixed recyclables (paper, cardboard, glass, metal - all food packaging must be clean), including the appropriate liners. These bins are located on the terrace outside of the Kitchen. It is the responsibility of RKC to empty these bins at the end of your hire period. 

4.3 Any non-recyclable waste must be put in the main bin inside the Kitchen. It is your responsibility to remove these black bin bags from the site at the end of each day of your booking and place in the large brown bins outside. No black bin bags must be left inside the building or in the garden overnight. It is the responsibility of RKC to empty these bins at the end of your hire period. 

4.4 Items such as ingredients and equipment can only be stored in the Kitchen overnight by prior arrangement with RKC. 

4.5 You must not use any ingredients or other consumables stored in the kitchen and other storage areas without prior agreement of RKC.  Any losses may be deducted from your deposit.

4.6 You must remove any leftover food and / or catering equipment from the premises at the end of your hire.

5. Food Safety
5.1 All hirers of the Kitchen are expected to adhere to the food hygiene guidelines as stated in our Food Safety and Hygiene guidelines.  

5.2 Rhyl Community Primary School is a nut-free school and pupils use the Kitchen on a regular basis. You may use nuts during your booking but it is essential that you remove all traces of nuts after each hire and notify the Project Manager immediately if there are spillages or concerns. 

5.3 Products developed and consumed either on the premises or distributed for consumption by others are done at your own risk. RKC accepts no liability for any processes conducted or products developed or produced or stored or distributed within or from the Kitchen. Commercial Hirers retain full, exclusive responsibility for compliance with all relevant food safety regulations, trace allergen controls, and local authority registration requirements for products distributed from the Kitchen.

6. Insurance & Liability
6.1 You are responsible for any damage (including accidental) to the premises or equipment that occur during the hire period. You may be asked to pay the cost of any repair or replacement.

6.2 You are responsible for any injuries to yourself, your staff, volunteers, guests, or participants that occur during the hire period. 

6.3 RKC is not liable for any lost or stolen personal items.

6.4 Certain activities - specifically any booking meeting the definition of a Commercial Hire below - shall require the Hirer to maintain their own independent insurance cover. “Commercial Hire” means any booking where the Kitchen is used by an individual, group, or organisation to generate a profit, trade goods, charge an admission fee for a workshop/event, or manufacture food products destined for commercial sale. For Public Liability insurance, cover to a minimum of £5,000,000 is required. If you are a company or organisation with employees or working with third parties, Employers' Liability insurance is required with cover to a minimum of £10,000,000. 

If your booking is a Commercial Hire, the Hirer warrants and guarantees that they hold a valid Public Liability Insurance policy with a minimum limit of £5,000,000 that explicitly covers their specific commercial activities, catering operations, and use of third-party kitchen facilities at Rhyl Kitchen Classroom. The Hirer warrants that their policy contains no exclusions or restrictions that would invalidate coverage while operating within the Kitchen. RKC may request a copy of your Public Liability Certificate Summary for a visual check only.  

6.5 The Hirer agrees to fully indemnify, defend, and hold harmless Rhyl Kitchen Classroom CIC against all claims, losses, damages, liabilities, and expenses (including legal fees) arising out of or in connection with the Hirer’s use of the Kitchen. This indemnity applies irrespective of whether the Hirer's insurance provider accepts or denies coverage for the incident. 

7. Safeguarding
7.1. RKC takes safeguarding extremely seriously and expects the Hirer to take the same levels of responsibility. A copy of our Safeguarding Children policy can be found on our website 

7.2. The Hirer must ensure that the recruitment of staff running the activities is compliant with DFE guidance on safer recruitment – "Keeping children safe in education". If requested, the Hirer must be able to provide evidence that DBS checks have been carried out for all relevant adults. 

7.3.  RKC must be informed immediately if there are any concerns relating to the safeguarding of children.

7.4 Children must always be supervised by an adult and must not be left unattended. 

8. Health and Safety
8.1 The Hirer is responsible for familiarising themselves with the procedure for evacuation of the premises, escape routes, assembly points and shall be familiar with the fire-fighting equipment available. The procedures are displayed on the wall by the door to the Kitchen. The Hirer is responsible for communicating this information to their staff, helpers and guests. 

8.2. Fire-fighting apparatus shall be kept in its proper place and only used for its intended purpose. The Fire Brigade shall be called to any outbreak of fire, however slight, and details of the occurrence shall be given to RKC.

8.3 Candles, fireworks, and other flammable materials are not permitted.  No internal decorations of a combustible nature (eg. polystyrene, cotton, hay, etc.) shall be undertaken or erected.

8.4. RKC has a first-aid kit in the room and its location is clearly indicated. However, it is the responsibility of the Hirer to make their own first aid arrangements, such as the provision of a first aid kit, and the provision of first aid training for supervising personnel. There is no legal requirement for RKC to provide first aid facilities.

9. Use of Outdoor Wood Fired Oven & Commercial Rational Oven
9.1 If you are using an oven during the hire, please use the domestic-style oven in the left of the room. The outdoor wood fired oven and Rational commercial oven require additional training / induction and may not be used without prior written consent from Rhyl Kitchen Classroom. You are responsible for any damage (including accidental) to these items of equipment that occur during the hire period. You will be asked to pay the cost of any repair or replacement.

10. The Deposit
10.1 You will need to pay a £100 deposit in advance of your first booking. This will be returned within two weeks of the end of the hire period providing that you have adhered to these Terms and Conditions. We reserve the right to retain the deposit, or a fraction of the deposit, if there have been breakages, missing items or if we need to clean the Kitchen or repair any equipment as per these Conditions. We also reserve the right to make additional charges to cover any damages if required. 

11. The Total Hire Charge
11.1 The Total Hire Charge will be payable prior to the start of each booking. We accept BACS payments only and our bank details are stated on the bottom of our invoices.

12. Keys, Codes and Padlocks
12.1 Keys remain our property. You must not duplicate, share, or lend them without permission. Lost keys incur a £20 charge.

12.2 You must not share the passcodes for any padlocks. 

12.3 It is your responsibility to lock the doors and windows when you leave.

13. Noise
13.1 You must not cause noise disturbances, such as loud music or shouting, that may disrupt school staff, volunteers, or nearby residents.

14. Cancellation Policy
14.1 RKC reserves the right to terminate contracts and bookings at its own discretion. A full refund will be given for cancelled bookings. We are not liable for any additional costs you may incur due to cancellation.

14.2 If the hirer wishes to cancel a booking, the following terms apply: No refunds for cancellations made 14 days or less before date of booking; 50% refund for cancellations made 14-28 days before date of booking; Full refund - less £30 admin charge - for cancellations made more than 28 days before date of booking.

15. Smoking & Vaping
15.1 You must not smoke or vape in the Kitchen, garden or school grounds.

16. Complaints
16.1 Any complaints must be submitted in writing to RKC. You will find full details of our Complaints Policy on our website. We will respond within ten working days from the date of receipt.

17. General
17.1 We reserve the right to exclude you from the Kitchen and school grounds if you are in breach of any of the provisions of these Conditions or we deem your behaviour to be unacceptable.

17.2 You must not carry out any illegal activities or store anything illegal in the Kitchen.

17.3 Lettings will not be made to any person or organisation or group with an unlawful or extremist background.
